فرانسیس آدولف پرنی و مواجهه با موانع نهادی و اجتماعی در فرایند اصلاح و تحوّل نظام قضایی ایران «1291–۱۳04 ش»

چکیده

با پیروزی انقلاب مشروطه ( 1285.ش ) اصلاح و تحوّل نظام قضایی ( عدلیه ) به عنوان یکی از اهداف و نیز ارکان اصلی مدرن‌سازی دولت – ملّت مطرح بود. برای دسترسی به این منظور در سال 1291.ش با تأیید و تصویب دولت و مجلس شورای ملی فرانسیس آدولف پرنی، مستشار حقوقی از فرانسه، استخدام و مأموریت یافت تا ساختار عدلیّه را بازسازی و متحوّل کند. پرنی اما در مواجهه با ساختار قضایی ایران با چالش‌های متعدد نهادی و اجتماعی روبرو بود. پژوهش حاضر درصدد است به این سوال پاسخ دهد که چه موانع یا چالش‌های نهادی و اجتماعی اقدامات پرنی را در ساختار قضایی ایران تحت تأثیر قرار داده است و نیز رویکرد و روش وی در فرایند این اصلاح و تغییر بر چه مبنایی استوار بوده است؟ یافته‌های این پژوهش تاریخی که با استفاده از شیوه توصیفی - تحلیلی صورت‌گرفته نشان می‌دهد که اقدامات اصلاحی پرنی با سه لایه از چالش‌های بنیادین از جمله تقابل ساختاری نظام حقوقی شرع و عرف، رقابت‌های ژئوپلتیک قدرت‌های خارجی در ایران و نیز عدم اعتماد و یا تردید بخشی از نخبگان سیاسی و اجتماعی به کارآمدی و اثربخشی اقدامات وی مواجه بوده است. و از آنجا که رویکرد وی برای اصلاح و تغییر غالباً برپایه ترجمه و نیز الگوبرداری از قوانین شکلی و ماهوی فرانسه بود این چالش‌ها عمدتاً شدت یافته است. اطلاعات و داده‌های پژوهش به صورت کتابخانه‌ای و نیز با بهره‌گیری از منابع دست اول از جمله مذاکرات مجلس شورای ملّی گردآوری شده است.

Abstract

Following the victory of the Constitutional Revolution (1285 SH), the reform and transformation of the judicial system (Adliyeh) emerged as one of the primary objectives and key pillars of nation-state modernization in Iran. To achieve this goal, in 1291 SH, with the approval and ratification of the government and the National Consultative Assembly, Francis Adolphe Perny, a French legal advisor, was recruited and tasked with reconstructing and transforming the structure of the Iranian judiciary. However, in confronting Iran’s judicial structure, Perny faced numerous institutional and social challenges. The present study seeks to answer the following question: What institutional and social obstacles or challenges influenced Perny’s reform efforts within Iran’s judicial system? Furthermore, on what foundations was his approach and methodology in this process of reform and change based? The findings of this historical research, conducted through a descriptive-analytical method, indicate that Perny’s reform initiatives encountered three layers of fundamental challenges. These included the structural conflict between the Sharia-based and customary legal systems, the geopolitical rivalries of foreign powers in Iran, and the lack of confidence or skepticism among segments of the political and social elites regarding the efficiency and effectiveness of his measures. Given that his approach to reform and change was primarily based on the translation and modeling of French formal and substantive laws, these challenges were significantly intensified.
